DEFINITII SI TERMENI:

  • LIGAHOSTING - este denumirea comerciala a societatii Despa Alexandru-Marian PFA, persoana juridica inregistrata la Registul Comertului cu nr. F2025003301006, cod unic de inregistrare RO51231468.
  • Client - poate fi orice persoana fizica care are varsta de 18 ani.
  • Site/Web/Website - pagina web care se regaseste la adresa https://ligahosting.ro.
  • Shop - pagina web care se regaseste la adresa https://ligahosting.ro/shop.
  • Cont - perechea formata dintr-o adresa de e-mail si o parola care permite accesul la server si site.
  • Billing - cunoscut ca si date de factuare, sunt necesare pentru generarea unei facturi catre client acolo unde metoda de plata sau autoritatile legale necesita acest lucru. Clientul isi asuma intreaga raspundere ca aceste date sunt corecte. Aceste date sunt folosite strict pentru facturare!
  • Email - adresa de e-mail inregistrata contului de pe server, care va fi utilizata pentru trimiterea de emailuri cu confirmarea comenzilor de pe shopul site-ului.
  • Comanda - cererea de cumparare a unui serviciu (game hosting, web hosting si alte servicii de hosting ce pot fi adaugate pe site).
  • Ticket - locatia unde se poate solicita ajutor pentru diverse probleme legate de shop, plati, livrare, etc. Ticketul se poate deschide accesand https://ligahosting.ro/ticket.
  • Reduceri - scaderea procentuala (sau a unei sume fixe) a unui serviciu de gazduire.

Partile contractante:

  • Beneficiarul: Orice persoana fizica sau juridica care utilizeaza serviciile furnizorului.
  • Furnizorul: Liga Hosting, cu datele de identificare mentionate mai sus.

Obiectul contractului:

  • Obiectul contractului il constituie furnizarea de catre Liga Hosting a urmatoarelor servicii:
  • Gazduirea site-urilor web (shared hosting).
  • Gazduire jocuri online (game hosting).
  • Servicii de suport tehnic si consultanta pentru clienti.
  • Servicii suplimentare de configurare (baze de date, panouri web, servere de jocuri).

Acceptarea conditiilor si renuntarea la dreptul de actionare in instanta:

  • Prin acceptarea prezentelor termeni si conditii, beneficiarul este de acord ca orice nemultumire sau litigiu care rezulta din utilizarea serviciilor furnizorului va fi solutionat pe cale amiabila, inainte de a lua orice masura legala.
  • Beneficiarul renunta in mod expres la dreptul de a actiona in instanta furnizorul, indiferent de motiv, si este obligat sa discute direct cu furnizorul pentru gasirea unei solutii rezonabile.

Valoarea serviciilor si termeni de plata:

  • Preturile serviciilor oferite de Liga Hosting sunt afisate pe site-ul oficial si sunt exprimate in RON sau EURO. Platile se fac in functie de optiunile de plata disponibile si sunt stabilite la cursul BNR + 2%.
  • Furnizorul va emite facturi proforme pe baza carora beneficiarul trebuie sa achite contravaloarea serviciului contractat. Facturile vor fi trimise prin e-mailul furnizat de beneficiar.
  • Neplata serviciilor poate duce la suspendarea temporara sau permanenta a serviciului contractat.

Politica de rambursare:

  • Toate platile efectuate pentru serviciile Liga Hosting sunt finale si nerambursabile, cu exceptia cazurilor in care plata a fost facuta din eroare sau fara acordul platitorului.
  • Rambursarile se pot solicita in termen de 14 zile de la achizitia initiala, doar pentru serviciile neutilizate. Solicitarile de rambursare trebuie facute printr-un e-mail la adresa de suport.
  • In cazul renuntarii anticipate la serviciile de gazduire, sumele platite nu se ramburseaza, cu exceptia situatiilor prevazute de lege.

Politica de anulare si incetarea serviciilor:

  • Beneficiarul poate renunta la serviciile contractate, notificand departamentul de plati printr-un ticket sau e-mail, cu minim 7 zile inainte de incheierea perioadei contractuale.
  • Furnizorul poate inceta furnizarea serviciilor in mod unilateral, fara notificare prealabila, in urmatoarele cazuri:
  • Neplata serviciilor.
  • Furnizarea de informatii false la inregistrare.
  • Implicarea in activitati ilegale, inclusiv utilizarea serviciilor pentru distribuirea de continut piratat sau atacuri informatice.
  • In cazul incalcarii termenilor si conditiilor de utilizare, contul beneficiarului poate fi suspendat fara preaviz.

Exonerarea de raspundere pentru pierderi de date si suspendarea serviciilor:

  • Liga Hosting nu poate fi facuta raspunzatoare pentru pierderi de date sau alte prejudicii cauzate de suspendarea serviciilor sau de factori tehnici care tin de infrastructura beneficiarului, inclusiv dar fara a se limita la: defectiuni hardware, atacuri informatice, virusi, erori software sau interventii umane.
  • In cazurile in care suspendarea sau pierderea datelor este cauzata de factori necontrolabili de catre Liga Hosting (de exemplu: forta majora, atacuri DDoS, caderi de retea, defectiuni globale ale infrastructurii de telecomunicatii), beneficiarul nu va avea dreptul la despagubiri financiare, insa, la cererea scrisa, poate primi o rambursare partiala a sumelor achitate, pe baza solicitarii trimise la adresa de contact a furnizorului.

Dreptul de proprietate si securitate:

  • Beneficiarul este responsabil pentru securitatea contului sau si a informatiilor asociate.
  • Furnizorul nu isi asuma raspunderea pentru utilizarea neautorizata a contului sau pentru pierderile de date cauzate de neglijenta beneficiarului.
  • Beneficiarul este obligat sa isi protejeze datele de autentificare si sa informeze imediat furnizorul in cazul oricaror suspiciuni de acces neautorizat.

Politica de utilizare acceptabila:

  • Serviciile furnizate de Liga Hosting trebuie utilizate in conformitate cu legislatia nationala si internationala.
  • Este strict interzisa utilizarea serviciilor pentru:
  • Transmiterea sau stocarea de materiale ilegale, defaimatoare, obscene sau care incalca drepturile de proprietate intelectuala.
  • Trimiterea de email-uri nesolicitate (spam).
  • Implicarea in atacuri informatice (DDoS, hacking) sau utilizarea retelei furnizorului pentru a compromite securitatea altor retele.
  • In cazul nerespectarii politicii de utilizare, furnizorul poate suspenda sau inceta furnizarea serviciilor, fara obligatia de a restitui sumele platite.

Limitarea raspunderii:

  • Liga Hosting nu este responsabila pentru pierderile suferite de beneficiar din cauza folosirii serviciilor, inclusiv pierderi de date, intreruperi ale serviciilor sau daune indirecte.
  • Furnizorul nu isi asuma raspunderea pentru daunele directe sau indirecte cauzate de utilizarea necorespunzatoare a serviciilor sau de accesul neautorizat la conturile beneficiarilor.
  • Beneficiarul este responsabil pentru orice pierderi rezultate din actiuni ale tertilor care utilizeaza contul sau.

Solutionarea disputelor:

  • In cazul oricaror dispute sau conflicte, beneficiarul si furnizorul sunt obligati sa incerce solutionarea pe cale amiabila, inainte de a recurge la actiuni legale.
  • Orice litigiu aparut intre parti in legatura cu utilizarea serviciilor oferite de Liga Hosting va fi solutionat pe cale amiabila, iar in cazul in care acest lucru nu este posibil, litigiul va fi solutionat de instantele competente din Romania.

Forta majora:

  • Niciuna dintre parti nu va fi responsabila pentru neindeplinirea obligatiilor contractuale din cauza unor evenimente de forta majora, inclusiv, dar fara a se limita la: razboi, catastrofe naturale, atacuri cibernetice, intreruperea retelelor de telecomunicatii sau alte evenimente independente de vointa partilor.

Confidentialitate:

  • Furnizorul se angajeaza sa protejeze confidentialitatea datelor personale furnizate de beneficiar in conformitate cu legislatia aplicabila privind protectia datelor cu caracter personal.
  • Datele beneficiarilor nu vor fi partajate cu terti fara consimtamantul prealabil, cu exceptia cazurilor in care legea impune acest lucru.

DEFINITIONS AND TERMS:

  • LIGAHOSTING - is the trade name of the company Despa Alexandru-Marian PFA, a legal entity registered with the Trade Register under no. F2025003301006, unique registration code RO51231468.
  • Client - can be any natural person who is 18 years of age.
  • Site/Web/Website - the webpage found at the address https://ligahosting.ro.
  • Shop - the webpage found at the address https://ligahosting.ro/shop.
  • Account - the pair consisting of an email address and a password which allows access to the server and site.
  • Billing - known as billing details, are necessary for generating an invoice to the client where the payment method or legal authorities require this. The client assumes full responsibility that these details are correct. This data is used strictly for billing!
  • Email - the email address registered to the server account, which will be used to send emails confirming orders from the site's shop.
  • Order - the request to purchase a service (game hosting, web hosting, and other hosting services that may be added to the site).
  • Ticket - the location where help can be requested for various issues related to the shop, payments, delivery, etc. A ticket can be opened by accessing https://ligahosting.ro/ticket.
  • Discounts - the percentage reduction (or a fixed amount) of a hosting service.

Contracting Parties:

  • Beneficiary: Any natural or legal person using the provider's services.
  • Provider: Liga Hosting, with the identification details mentioned above.

Object of the Contract:

  • The object of the contract is the provision by Liga Hosting of the following services:
  • Website hosting (shared hosting).
  • Online game hosting (game hosting).
  • Technical support and consulting services for clients.
  • Supplementary configuration services (databases, web panels, game servers).

Acceptance of Terms and Waiver of the Right to Legal Action:

  • By accepting these terms and conditions, the beneficiary agrees that any dissatisfaction or dispute resulting from the use of the provider's services will be resolved amicably before taking any legal action.
  • The beneficiary expressly waives the right to take legal action against the provider, regardless of the reason, and is obliged to discuss directly with the provider to find a reasonable solution.

Service Value and Payment Terms:

  • The prices for services offered by Liga Hosting are displayed on the official website and are expressed in RON or EURO. Payments are made according to the available payment options and are set at the BNR exchange rate + 2%.
  • The provider will issue proforma invoices based on which the beneficiary must pay the value of the contracted service. Invoices will be sent via the email provided by the beneficiary.
  • Non-payment of services may lead to temporary or permanent suspension of the contracted service.

Refund Policy:

  • All payments made for Liga Hosting services are final and non-refundable, except in cases where the payment was made in error or without the payer's consent.
  • Refunds can be requested within 14 days of the initial purchase, only for unused services. Refund requests must be made via email to the support address.
  • In case of early termination of hosting services, the amounts paid are not refunded, except for situations provided by law.

Cancellation Policy and Service Termination:

  • The beneficiary may terminate the contracted services by notifying the billing department via a ticket or email, with a minimum of 7 days before the end of the contractual period.
  • The provider may unilaterally cease service provision without prior notice in the following cases:
  • Non-payment of services.
  • Provision of false information upon registration.
  • Involvement in illegal activities, including using the services to distribute pirated content or cyber attacks.
  • In case of violation of the terms and conditions of use, the beneficiary's account may be suspended without notice.

Liability Exemption for Data Loss and Service Suspension:

  • Liga Hosting cannot be held responsible for data loss or other damages caused by service suspension or technical factors related to the beneficiary's infrastructure, including but not limited to: hardware failures, cyber attacks, viruses, software errors, or human intervention.
  • In cases where suspension or data loss is caused by factors uncontrollable by Liga Hosting (for example: force majeure, DDoS attacks, network outages, global telecommunications infrastructure failures), the beneficiary will not have the right to financial compensation; however, upon written request, they may receive a partial refund of the amounts paid, based on the request sent to the provider's contact address.

Ownership Rights and Security:

  • The beneficiary is responsible for the security of their account and associated information.
  • The provider assumes no liability for unauthorized use of the account or for data losses caused by the beneficiary's negligence.
  • The beneficiary is obliged to protect their login credentials and to immediately inform the provider in case of any suspicion of unauthorized access.

Acceptable Use Policy:

  • Services provided by Liga Hosting must be used in accordance with national and international legislation.
  • It is strictly prohibited to use the services for:
  • Transmitting or storing illegal, defamatory, obscene materials, or materials that infringe intellectual property rights.
  • Sending unsolicited emails (spam).
  • Involvement in cyber attacks (DDoS, hacking) or using the provider's network to compromise the security of other networks.
  • In case of non-compliance with the use policy, the provider may suspend or terminate service provision without the obligation to refund any amounts paid.

Limitation of Liability:

  • Liga Hosting is not responsible for losses suffered by the beneficiary due to the use of the services, including data loss, service interruptions, or indirect damages.
  • The provider assumes no liability for direct or indirect damages caused by improper use of the services or by unauthorized access to beneficiary accounts.
  • The beneficiary is responsible for any losses resulting from actions of third parties using their account.

Dispute Resolution:

  • In case of any disputes or conflicts, the beneficiary and the provider are obliged to attempt amicable resolution before resorting to legal actions.
  • Any dispute arising between the parties regarding the use of services offered by Liga Hosting will be resolved amicably, and if this is not possible, the dispute will be settled by the competent courts in Romania.

Force Majeure:

  • Neither party shall be liable for failure to perform contractual obligations due to force majeure events, including but not limited to: war, natural disasters, cyber attacks, interruption of telecommunications networks, or other events beyond the control of the parties.

Confidentiality:

  • The provider undertakes to protect the confidentiality of personal data provided by the beneficiary in accordance with applicable legislation regarding the protection of personal data.
  • Beneficiary data will not be shared with third parties without prior consent, except in cases where the law requires it.
